Now In: Tel-Tru Limited Product Warranty

LIMITED WARRANTY

A.    Tel-Tru warrants certain designated bimetal thermometers (Models AA375R, AA475R, AA575R, BC350R, BC450R, BC550R, GT300R, GT400R, and GT500R) manufactured and sold by us to be free from defects in material and workmanship under normal use and service for eight (8) years after the date of purchase. Tel-Tru warrants certain designated Digi-Tel thermometers (Models D1, D5, D4, ND1, ND5, SD1, SD5) manufactured and sold by us to be free from defects in workmanship or materials under normal use and service for five (5) years after date of purchase. Tel-Tru warrants Pressure Transmitter P600 Series manufactured and sold by us to be free from defects in workmanship or materials under normal use and service for three (3) years after date of purchase. All other Tel-Tru products are warranted to be free from defects in workmanship or materials under normal use and service for one (1) year after date of purchase. In each case, proof of purchase is required to substantiate a warranty claim.

B.    Tel-Tru’s sole and exclusive obligation under this limited warranty shall be at Tel-Tru’s option to the repair, exchange or credit of the original purchase price of any Tel-Tru product which shall be returned to our factory, transportation charges prepaid, within the designated warranty period, and which our examination shall disclose to be defective due to workmanship or material.

C.    Tel-Tru must be notified in advance of, and approve, any return of purported defective products by issuing a Return Material Authorization (RMA) Number. The purportedly defective products are to be returned to Tel-Tru transportation prepaid. Products returned without an RMA number will not be accepted and be returned to sender at sender’s expense.

D.    THIS WARRANTY IS EXPRESSLY IN LIEU OF ALL OTHER WARRANTIES EXPRESS OR IMPLIED, INCLUDING THE WARRANTIES OF MERCHANTABILITY AND FITNESS FOR USE OR FOR A PARTICULAR PURPOSE AND OF ALL OTHER OBLIGATIONS OR LIABILITIES ON THE PART OF TEL-TRU. TEL-TRU NEITHER ASSUMES NOR AUTHORIZES ANY OTHER PERSON TO ASSUME FOR IT, ANY OTHER WARRANTY OR LIABILITY IN CONNECTION WITH THE SALE HEREUNDER. TEL-TRU DISCLAIMS ANY LIABILITY FOR PRODUCT DEFECTS THAT ARE DUE TO PRODUCT MISUSE, IMPROPER PRODUCT SELECTION OR MISAPPLICATION.

E.     Tel-Tru shall not be liable for customer's costs, lost profits, good will or other incidental, special or consequential damages. Tel-Tru’s liability in all events is limited to, and shall not exceed, the value of merchandise involved.

F.     Remedies - Any controversy or claim arising out of or relating to this warranty, or the breach thereof, shall be settled by arbitration in Monroe County, State of New York in accordance with the Commercial Arbitration Rules of the American Arbitration Association, and judgment on the award rendered by the arbitrator(s) may be entered in a court having jurisdiction there.

G.    Recommendations for using Tel-Tru products are believed to be reliable. However, since the application of these items is beyond our control, no warranty or guarantee, express or implied, is made on their use, handling, possession or results.

H.    This warranty shall be null and void if any Tel-Tru instrument is exposed or subjected to:

  1. Corrosive chemicals, either environmentally or through manufacturing processes
  2. Temperatures or pressures in excess of the rated limits
  3. Any application which subjects the instrument to excessive vibration or causes violation of the sensor or case enclosure
  4. Any abuse, neglect, accident, incorrect wiring (not provided by Tel-Tru), improper installation or servicing, or use in violation of instructions furnished by Tel-Tru
  5. Any repair or alteration by anyone except Tel-Tru or its authorized service agencies
  6. The serial number being removed, defaced, or otherwise changed
  7. Examination which discloses, in the judgement of Tel-Tru, a defect in materials or workmanship which did not develop under normal installation, use and service
